  1. Sun Microsystems, Inc.  Binary Code License Agreement
  2.  
  3. READ THE TERMS OF THIS AGREEMENT AND ANY PROVIDED
  4. SUPPLEMENTAL LICENSE TERMS (COLLECTIVELY "AGREEMENT")
  5. CAREFULLY BEFORE OPENING THE SOFTWARE MEDIA PACKAGE.  BY
  6. OPENING THE SOFTWARE MEDIA PACKAGE, YOU AGREE TO THE TERMS
  7. OF THIS AGREEMENT.  IF YOU ARE ACCESSING THE SOFTWARE
  8. ELECTRONICALLY, INDICATE YOUR ACCEPTANCE OF THESE TERMS BY
  9. SELECTING THE "ACCEPT" BUTTON AT THE END OF THIS
  10. AGREEMENT.  IF YOU DO NOT AGREE TO ALL THESE TERMS,
  11. PROMPTLY RETURN THE UNUSED SOFTWARE TO YOUR PLACE OF
  12. PURCHASE FOR A REFUND OR, IF THE SOFTWARE IS ACCESSED
  13. ELECTRONICALLY, SELECT THE "DECLINE" BUTTON AT THE END OF
  14. THIS AGREEMENT.
  15.  
  16. 1.  LICENSE TO USE.  Sun grants you a non-exclusive and
  17. non-transferable license for the internal use only of the
  18. accompanying software and documentation and any error
  19. corrections provided by Sun (collectively "Software"), by
  20. the number of users and the class of computer hardware for
  21. which the corresponding fee has been paid.
  22.  
  23. 2.  RESTRICTIONS  Software is confidential and copyrighted.
  24. Title to Software and all associated intellectual property
  25. rights is retained by Sun and/or its licensors.  Except as
  26. specifically authorized in any Supplemental License Terms,
  27. you may not make copies of Software, other than a single
  28. copy of  Software for archival purposes.  Unless
  29. enforcement is prohibited by applicable law, you may not
  30. modify, decompile, or reverse engineer Software.  You
  31. acknowledge that Software is not designed, licensed or
  32. intended for use in the design, construction, operation or
  33. maintenance of any nuclear facility.  Sun disclaims any
  34. express or implied warranty of fitness for such uses.  No
  35. right, title or interest in or to any trademark, service
  36. mark, logo or trade name of Sun or its licensors is granted
  37. under this Agreement.  " 3. LIMITED WARRANTY.  Sun warrants
  38. to you that for a period of ninety (90) days from the date
  39. of purchase, as evidenced by a copy of the receipt, the
  40. media on which Software is furnished (if any) will be free
  41. of defects in materials and workmanship under normal use.
  42. Except for the foregoing, Software is provided "AS IS".
  43. Your exclusive remedy and Sun's entire liability under this
  44. limited warranty will be at Sun's option to replace
  45. Software media or refund the fee paid for Software.
  46.  
  47. 4.  DISCLAIMER OF WARRANTY.  UNLESS SPECIFIED IN THIS
  48. AGREEMENT, ALL EXPRESS OR IMPLIED CONDITIONS,
  49. REPRESENTATIONS AND WARRANTIES, INCLUDING ANY IMPLIED
  50. WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
  51. PURPOSE OR NON-INFRINGEMENT ARE DISCLAIMED, EXCEPT TO THE
  52. EXTENT THAT THESE DISCLAIMERS ARE HELD TO BE LEGALLY
  53. INVALID.
  54.  
  55. 5.  LIMITATION OF LIABILITY.  TO THE EXTENT NOT PROHIBITED
  56. BY LAW, IN NO EVENT WILL SUN OR ITS LICENSORS BE LIABLE FOR
  57. ANY LOST REVENUE, PROFIT OR DATA, OR FOR SPECIAL, INDIRECT,
  58. CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES, HOWEVER
  59. CAUSED REGARDLESS OF THE THEORY OF LIABILITY, ARISING OUT
  60. OF OR RELATED TO THE USE OF OR INABILITY TO USE SOFTWARE,
  61. EVEN IF SUN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH
  62. DAMAGES.  In no event will Sun's liability to you, whether
  63. in contract, tort (including negligence), or otherwise,
  64. exceed the amount paid by you for Software under this
  65. Agreement.  The foregoing limitations will apply even if
  66. the above stated warranty fails of its essential purpose.

  68. 6.  Termination.  This Agreement is effective until
  69. terminated.  You may terminate this Agreement at any time
  70. by destroying all copies of Software.  This Agreement will
  71. terminate immediately without notice from Sun if you fail
  72. to comply with any provision of this Agreement.  Upon
  73. Termination, you must destroy all copies of Software.

  75. 7.  Export Regulations.  All Software and technical data
  76. delivered under this Agreement are subject to US export
  77. control laws and may be subject to export or import
  78. regulations in other countries.  You agree to comply
  79. strictly with all such laws and regulations and acknowledge
  80. that you have the responsibility to obtain such licenses to
  81. export, re-export, or import as may be required after
  82. delivery to you.

  84. 8.  U.S. Government Restricted Rights.  If Software is
  85. being acquired by or on behalf of the U.S. Government or by
  86. a U.S. Government prime contractor or subcontractor (at any
  87. tier), then the Government's rights in Software and
  88. accompanying documentation will be only as set forth in
  89. this Agreement; this is in accordance with 48 CFR 227.7201
  90. through 227.7202-4 (for Department of Defense (DOD)
  91. acquisitions) and with 48 CFR 2.101 and 12.212 (for non-DOD
  92. acquisitions).

  94. 9.  Governing Law.  Any action related to this Agreement
  95. will be governed by California law and controlling U.S.
  96. federal law.  No choice of law rules of any jurisdiction
  97. will apply.
  98.  
  99. 10.  Severability. If any provision of this Agreement is
  100. held to be unenforceable, this Agreement will remain in
  101. effect with the provision omitted, unless omission would
  102. frustrate the intent of the parties, in which case this
  103. Agreement will immediately terminate.

  105. 11.  Integration.  This Agreement is the entire agreement
  106. between you and Sun relating to its subject matter.  It
  107. supersedes all prior or contemporaneous oral or written
  108. communications, proposals, representations and warranties
  109. and prevails over any conflicting or additional terms of
  110. any quote, order, acknowledgment, or other communication
  111. between the parties relating to its subject matter during
  112. the term of this Agreement.  No modification of this
  113. Agreement will be binding, unless in writing and signed by
  114. an authorized representative of each party.

  122. 1.3 SUPPLEMENTAL LICENSE TERMS
  123.  
  124. These supplemental license terms ("Supplemental Terms") add
  125. to or modify the terms of the Binary Code License Agreement
  126. (collectively, the "Agreement"). Capitalized terms not
  127. defined in these Supplemental Terms shall have the same
  128. meanings ascribed to them in the Agreement.  These
  129. Supplemental Terms shall supersede any inconsistent or
  130. conflicting terms in the Agreement, or in any license
  131. contained within the Software.

  133. 1. Internal Use and Development License Grant. Subject to
  134. the terms and conditions of this Agreement, including, but
  135. not limited to, Section 2 (Redistributables) and Section 4
  136. (Java Technology Restrictions) of these Supplemental Terms,
  137. Sun grants you a non-exclusive, non-transferable, limited
  138. license to reproduce the Software for internal use only for
  139. the sole purpose of development of your JavaTM applet and
  140. application ("Program"), provided that you do not
  141. redistribute the Software in whole or in part, either
  142. separately or included with any Program.
  143.  
  144. 2. Redistributables. In addition to the license granted in
  145. Paragraph 1 above, Sun grants you a non-exclusive,
  146. non-transferable, limited license to reproduce and
  147. distribute, only as part of your separate copy of JAVA(TM)
  148. 2 RUNTIME ENVIRONMENT STANDARD EDITION VERSION 1.3
  149. software, those files specifically identified as
  150. redistributable in the JAVA(TM) 2 RUNTIME ENVIRONMENT
  151. STANDARD EDITION VERSION 1.3  "README" file (the
  152. "Redistributables") provided that: (a) you distribute the
  153. Redistributables complete and unmodified (unless otherwise
  154. specified in the applicable README file), and only bundled
  155. as part of the JavaTM applets and applications that you
  156. develop (the "Programs:);  (b) you do not distribute
  157. additional software intended to supersede any component(s)
  158. of the Redistributables; (c) you do not remove or alter any
  159. proprietary legends or notices contained in or on the
  160. Redistributables;  (d) you only distribute the
  161. Redistributables pursuant to a license agreement that
  162. protects !  Sun's interests consistent with the terms
  163. contained in the Agreement, and (e) you agree to defend and
  164. indemnify Sun and its licensors from and against any
  165. damages, costs, liabilities, settlement amounts and/or
  166. expenses (including attorneys' fees) incurred in connection
  167. with any claim, lawsuit or action by any third party that
  168. arises or results from the use or distribution of any and
  169. all Programs and/or Software.

  171. 3. Separate Distribution License Required. You understand
  172. and agree that you must first obtain a separate license
  173. from Sun prior to reproducing or modifying any portion of
  174. the Software other than as provided with respect to
  175. Redistributables in Paragraph 2 above.
  176.  
  177. 4. Java Technology Restrictions. You may not modify the
  178. Java Platform Interface ("JPI", identified as classes
  179. contained within the "java" package or any subpackages of
  180. the "java" package), by creating additional classes within
  181. the JPI or otherwise causing the addition to or
  182. modification of the classes in the JPI.  In the event that
  183. you create an additional class and associated API(s) which
  184. (i) extends the functionality of a Java environment, and
  185. (ii) is exposed to third party software developers for the
  186. purpose of developing additional software which invokes
  187. such additional API, you must promptly publish broadly an
  188. accurate specification for such API for free use by all
  189. developers.  You may not create, or authorize your
  190. licensees to create additional classes, interfaces, or
  191. subpackages that are in any way identified as "java",
  192. "javax", "sun" or similar convention as specified by Sun in
  193. any class file naming convention. Refer to the appropriate
  194. version of the Java Runtime Envir!  onment binary code
  195. license (currently located at
  196. http://www.java.sun.com/jdk/index.html) for the
  197. availability of runtime code which may be distributed with
  198. Java applets and applications.
  199.  
  200. 5. Trademarks and Logos. You acknowledge and agree as
  201. between you and Sun that Sun owns the Java trademark and
  202. all Java-related trademarks, service marks, logos and other
  203. brand designations including the Coffee Cup logo and Duke
  204. logo ("Java Marks"), and you agree to comply with the Sun
  205. Trademark and Logo Usage Requirements currently located at
  206. http://www.sun.com/policies/trademarks. Any use you make of
  207. the Java Marks inures to Sun's benefit.

  209. 6. Source Code. Software may contain source code that is
  210. provided solely for reference purposes pursuant to the
  211. terms of this Agreement.

  213. 7. Termination. Sun may terminate this Agreement
  214. immediately should any Software become, or in Sun's opinion
  215. be likely to become, the subject of a claim of infringement
  216. of a patent, trade secret, copyright or other intellectual
  217. property right.
